Terms of Service
These Terms of Service ("Terms") govern use of the IronLinx platform ("Platform") by both registered companies ("Company") and drivers ("Driver"). They sit alongside, and do not replace, the company's End User Licence Agreement, which separately governs a Company's licence to access the Platform.
1. Role of the Platform
IronLinx operates the Platform connecting Companies with Drivers. The working relationship for a shift depends on how it is posted:
- Employed shifts: the Driver is engaged by IronLinx under a contract of employment (including, where applicable, a zero-hours contract), and IronLinx assigns the Driver to the Company to perform the shift. IronLinx is the Driver's employer for that engagement.
- Self-Employed shifts (only available to Companies that have declared themselves outside IR35): the Driver provides their services as a self-employed contractor, and the agreement for the performance of that shift is formed directly between the Driver and the Company. IronLinx facilitates that agreement but is not a party to it, and is not the Driver's employer for that engagement.
2. Prohibited Use
When using the Platform, including its messaging features, you must not:
- send messages that are not related to the work in question, or that are abusive, threatening, or harassing;
- divulge personal data (about a Driver, another user, or any individual) or Company-related data obtained through the Platform to anyone outside the Platform, or use it for any purpose other than performing the shift in question;
- use the Platform for any unlawful purpose, or attempt to circumvent its marketplace, ratings, or compliance checks.
A breach of this section may result in suspension or termination of the offending user's account.
3. Shift Acceptance
A Driver's acceptance of an Employed shift assigns that Driver, as IronLinx's employee, to the Company to perform the shift. A Driver's acceptance of a Self-Employed shift forms a binding agreement directly between that Driver and the Company for the performance of the work described.
In either case, the Company agrees to pay for the shift at the rate agreed for that shift, calculated from the Driver's tachograph-recorded hours, including any correction made to a shift by way of manual entry during the following week — see our How it works page for how tachograph data and corrections are handled.
4. Driver Pay
IronLinx invoices the Company for the Driver's wages for each shift. IronLinx pays the Driver by BACS payment, due by the Friday of the week following the week in which the shift was worked, regardless of whether the Company has paid IronLinx's invoice by that date. This applies equally to Employed and Self-Employed shifts — IronLinx pays the Driver in both cases; only the tax treatment differs (see below).
For a Self-Employed shift, the Driver is paid gross, with no tax or National Insurance deducted, and is responsible for their own tax affairs. For an Employed shift, pay is processed through a payroll system, with PAYE income tax and National Insurance contributions deducted and remitted to HMRC as required.
Where a manual entry correcting a shift is made during that following pay week, the amount affected by that correction falls outside the standard Friday payment for that week and is instead settled in the next available BACS run once the correction has been processed.
5. Driver Eligibility and Ratings
Drivers are subject to DVLA and eligibility checks as described in our Privacy Policy, and to the Platform's two-way rating system. A Company and a Driver may each rate the other following a shift; persistently poor ratings, reliability issues, or confirmed compliance breaches may affect a user's ability to use the Platform.
6. Location Tracking
The Casual Drivers App uses your device's location, while the app is in use, for on-site status tracking during a shift, safety features (SOS and Emergency Alert), and pre-shift movement checks. This is a live tracking indicator only — your pay is calculated solely from your tachograph-recorded hours (see Section 3), never from GPS or phone location data.
This location tracking is based on your consent, which you give (and may withdraw at any time) in the Driver App's own settings. See our Privacy Policy for full detail on what location data is collected and why.
7. Suspension and Termination
IronLinx may suspend or terminate a user's access to the Platform for breach of these Terms, fraudulent activity, or conduct that puts other users or the integrity of the Platform at risk. This is separate from, and does not affect, the termination provisions in a Company's EULA.
8. Liability
For Self-Employed shifts, IronLinx is not a party to the agreement formed between the Driver and the Company, and is not liable for its performance by either party. For Employed shifts, IronLinx's obligations as employer are as set out in the Driver's contract of employment, not in these Terms. Nothing in this section excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.
9. Changes to These Terms
IronLinx may update these Terms from time to time. Continued use of the Platform after an update takes effect constitutes acceptance of the revised Terms.
10. Governing Law and Jurisdiction
These Terms are governed by the law of England and Wales, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
